These Terms govern your use of bizfloo.com and any web-development, branding, or marketing services delivered by Bizfloo Branding, based in Raleigh, NC 27601. By using the site or engaging us for a project, you agree to these Terms.
1. Services
We design, build, and maintain custom websites and related digital assets. Specific deliverables, timeline, and price are defined in a separate proposal or invoice for each engagement.
2. Payment terms
- Projects over $250 require a $250 deposit via Square invoice before work begins. The remaining balance is due on completion.
- Projects of $250 or less are due in full upfront.
- Customers may pay any amount toward an open invoice — partial payments are accepted, but the deposit must clear before work starts.
- Sales tax (where applicable) is computed by Square and added to the invoice. Currently, NC sales tax of 7.25% applies only to taxable digital goods, not pure web-development services.
3. Refund policy
See our Refund Policyfor full details. In short: deposits are non-refundable once work has begun. The $125 deposit on an instant website is non-refundable, because work starts as soon as it's paid. Balance payments are refundable on a prorated basis if we cannot deliver the agreed scope.
4. Intellectual property
Once a project is paid in full, ownership of the final website and any custom-created assets transfers to you. We retain the right to display the project in our portfolio unless you request otherwise in writing. Third-party assets (fonts, stock photos, plugins) remain governed by their original licenses.
5. Customer responsibilities
- Provide content, accounts, and approvals in a timely manner.
- Confirm the legality of any content you ask us to publish.
- Maintain valid hosting, domain, and third-party service accounts (hosting and database providers, Square, etc.) once the project transfers to you.
6. Acceptable use
You agree not to use the site or services to violate laws, infringe intellectual property, harm minors, transmit malware, or abuse our AI tools. We may suspend or terminate access for violations.
7. Limitation of liability
To the maximum extent permitted by law, Bizfloo Branding is not liable for indirect, incidental, or consequential damages arising from use of the site or services. Total liability for any claim is limited to the fees paid for the specific project at issue.
8. Disclaimers
The site and services are provided "as is" without warranties of any kind. We don't guarantee that the website will generate any specific business outcome (sales, leads, traffic).
9. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Wake County, North Carolina.
10. Changes
We may update these Terms from time to time. Continued use after a change constitutes acceptance.
11. Text message terms
Program:Bizfloo Account Alerts. You agree to texts by ticking the box on our quote form or at account setup. You'll get only account and project messages: confirmation of your website request, project updates, sign-in links, portal invites, invoice and payment notices, and notices about messages on your account. Message frequency varies. Msg & data rates may apply. Reply HELP for help, STOP to cancel, or START to resubscribe. For support, contact info@bizfloo.com. Carriers aren't liable for delayed or undelivered messages. Consent to texts isn't a condition of any purchase. See our Privacy Policy for how we handle your information.
Bizfloo Offers (promotional texts).Separately from Bizfloo Account Alerts, you may choose to receive marketing texts from Bizfloo about offers, new services and company updates. You join only by ticking the separate, unchecked “Text me Bizfloo offers and updates” box on our quote form or at account setup. Agreeing is optional and is not a condition of any purchase, and it does not affect your account texts. Up to 4 messages per month. Message and data rates may apply. Reply STOP to any message to opt out (STOP ends all Bizfloo texts to that number; reply START to rejoin), or HELP for help, or contact info@bizfloo.com. Carriers are not liable for delayed or undelivered messages. We do not share your mobile number or opt-in data with third parties for their marketing.
